A foreign company that wishes to get a work permit for one of its employees must first set up its Kenyan subsidiary/branch/representative office. This Kenyan entity may then apply for the work permit.
An applicant may make an application directly or choose an agent such as a law firm or consultancy. However, do note that direct applications take a longer time.
According to the Private Sector Kuwait Labor Law, each employer shall maintain a file for each worker wherein shall be kept copies of the worker’s work permit, work contract, civil ID, documents relevant to annual leaves and sick leaves, overtime hours, work injuries and occupational diseases, penalties imposed on the worker, end of service date and reasons behind, copy of receipts proving. Step 1: Completion of the application
Foreign nationals wishing to be employed by a Kenyan entity are required to apply for a Kenyan work permit. The different classes will depend on the specific circumstances of the applicant. Generally, the success rate depends on whether skilled labour for the position is available locally i.e. employers are required to justify employment of the foreign national instead of a local.
All work permits are generally valid for 2 years, with renewals permitted for an extra 2 years at a time. The number of renewals is unlimited. Renewals need to be done at least 3 months prior to expiry.
While each work permit may have specific documentation requirements, the following are all required:
- Dully filled and signed application Form 3
- Covering letter from employer/self/organisation depending on the class (as applicable)
- Copies of the foreign national’s passport
- Two coloured Passport size photographs
- Application form fee
Step 2: Submission to the Ministry of Immigration
Once the application is submitted at the Ministry of Immigration, it shall be presented to a committee for approval. This process may take between two and six months.
The following factors are considered by the committee when deciding whether to approve or reject an application:
1. The amount of investment and its impact on Kenya’s economy, which is determined by the auditors’ report or bank statement
2. The number of jobs that will be created for Kenyans, which is determined by the application letter submitted by the applicant’s agent
3. The nationality of the applicant. An applicant has a higher chance of approval of his application if his or her country of origin has a stronger economy’s than that of Kenya and low criminal statistics and security threats.
If the application is successful, the Ministry will issue a Notification of Approval will be issued. If it is rejected, a Notification of Rejection will be issued. This Notification of Approval is valid for ninety days pending payment of the government fees.
The entry permit is then endorsed on the applicant’s passport.

Step 3: Registration as an alien
All foreigners who remain in Kenya for more than 3 months (90 days) are required to register as an alien and obtain an alien registration card from the Immigration Department.
The application must be accompanied by:
1.Two passport –size photographs (either coloured or black and white and taken not more than 12 months earlier) of the applicant;
2.A valid passport or some other official document establishing identity and nationality; and
3.The prescribed fee
If it’s incomplete, we’ll return your application without processing it.
An officer will also check
- the list of employers who failed to comply with the conditions to make sure that the employer can hire you, and
- that you qualify for a work permit
Depending on the type of work you’ll be doing, you might need a medical exam. If you do, an officer will tell you and will send you instructions on what to do. A medical exam can add over 3 months to the time it takes us to process your application.
We may also ask you to send more information.
If you’re a visitor who is applying for a work permit in Canada and held a work permit in the last 12 months
You can ask to be allowed to work while we process your application.
Who’s eligible
You must
- be physically present in Canada when you apply
- be a visitor with valid status when you apply for the work permit
- if your visitor status has expired, you’ll need to restore your visitor status before you apply for a work permit
- applied for an employer-specific work permit between August 24, 2020, and August 31, 2021
- have held a work permit that was valid in the 12 months before you applied for a new work permit
How to get authorization to work while you wait
Follow these steps.

I understand that providing false, misleading or incorrect information is a violation of the Immigration and Refugee Protection Act and may result in enforcement measures against me.
Make sure you fill out the sections in square brackets, including the
- dates
- work permit number (begins with a “U”)
- name of your employer
- title of your job
If you applied on paper and don’t know your application number, include your courier tracking number. This will ensure we can find your application.
If you have other questions, you need to fill out a new IRCC Web form.
Step 2: Wait for us to contact you
You must wait for us to email you to let you know that you can start working. This may take up to 30 business days (6 weeks).
If you’re in Canada and your application is approved
If you were eligible to apply for a work permit from within Canada
If you were eligible to apply from within Canada, you filled out the form called Application to Change Conditions, Extend My Stay or Remain in Canada as a Worker [IMM 5710]. In that case, we’ll mail the work permit to the Canadian address you gave us. This also applies if you’re a visitor who applied for a work permit under a temporary public policy.
If your mailing address changes before we send you our decision, you must follow the instructions to tell us your new address.

If you followed the instructions to apply for a work permit from outside Canada
In this case, you filled out the form called Application for Work Permit Made Outside of Canada [IMM 1295].
If your application is approved, you’ll get an approval letter that says you’re allowed to work in Canada. This letter is called the port of entry letter of introduction.
After that, make sure you’re eligible and then ask to get your work permit.
Who’s eligible
To get your work permit without leaving Canada, you must meet these 4 requirements:
- you applied for a work permit
- you received your letter of introduction
- if you received a passport request letter, follow the instructions in that letter and then wait for your letter of introduction to arrive
- you have valid status in Canada
- if your status has expired, you must restore your status before you request your permit
- we received your request to issue your permit before August 31, 2021
- this is a temporary process to help applicants during the COVID-19 pandemic
Processing time and multiple requests
It will take at least 8 weeks for us to process your request.
Don’t make more than 1 request for your permit to be issued. Multiple requests slow down all processing.

If you have a work permit or a study permit, you have valid status until the date of expiry on your work or study permit.

If you’re a visitor in Canada and you have a visitor record, you have valid status until the date your visitor record expires. If you don’t have a visitor record, you normally have valid status for 6 months from the day you entered Canada.
